being duly sworn, on oath deposeth and says, that he attended as witness in the case wherein Joseph Smith is plaintiff, and & are defendants for four days at the May Term, A. D. 1844, of the Circuit Court of said at the instance of said plaintiff & that he resides in 160 miles from the place of holding this Court
