Read 9 Wendell 212. when a person is brought on Habeus C. court is not to enquire into the guilt or innocence— authority is against it, 9 wendell previous to 12 Wendell. & is all set aside. has he fled? & not, is he guilty?— if Smith was in this state, says , constructively in that state, I dont wish to go into a spiritual disquisition.— the words shall flee occurr 3 times in the constitution— the removal is not spiritually, but bodily.— look at it.— states have passed Laws to take effect out of the State where they were passd but they are void. suppose [p. 70]
