Personly appeared in open Court who being first duly sworn says that sometime in the Month of February or March 1844 he left on the table in the office of the of the Circuit Court in and for said a for the follawing witnesses viz Joseph Smith and Jacob Zandal [Zundel], with a request to the Clirke or his to file the same and issue a subpoena for said witnesses to appear at the present Term of said Court and testify on the part of the defendant in the case of William Niswanger against and Hamilton Jett and further says not
