On the 9th day of February 1844 came Jacob Shoemaker before me Joseph Smith Mayor of said and after being duly sworn deposeth and saith that on the 8th day of february 1844, near A. Hodges Blacksmith’s Shop in said . , of said did insult your said affiant, by calling your said affiant a liar, and by offering your said affiant other abusive language, and did violently assault your said affiant by attempting to shoot your said affiant with a pistol, and did otherwise assault and abuse your said affiant contrary to the statutes of said states, and against the peace and dignity of the people of the aforesaid and your said affiant prays that the said may be dealt with according to law
