Oct 6th Deft appeared and acknowledged Service. Held open for want of evidence and by consent of parties till Monday Morning 9 oclock
Oct 9th Met accordingly— Warrant returned personally served const fees .37½
Matter Called— Affidavit before read in evidence and admitted Christian Upperm[an], Mary Upperman, Elizabeth Mallery [Mallory] and Emiline Langley sworn on part of prosecution Levi Gifford, Deborah Gifford, priscilla Hoop[e]s, William Gifford Sworn on part of deft Elisha Hoop[e]s, & Lewis Hoop[e]s request fees as witnesses
Court Decided That Deft be held over for trial and this Court after hearing the evidence and arguments of counsel Consider and adjudge that the defendant be recognized to be and appear at the next Circuit Court on the first day thereof and that he enter into thereto in the penal sum of four hundred dollars with sufficient securites to answer said charge and in default thereof be committed. Bail not having been <​entered​> by the prisoner according to the order of the court. a was made out by me in due form of law, and delivered to Samuel Waterman Constable, for the commitment of the said charles Drown
