And now again Came the parties by their attornies and argued the motion entered herein heretofore to dismiss this suit and the Court being fully advised in the Premises is of opinion that the Said motion be sustained and that the Said Suit be dismissed for want of Jurisdiction of the Court below Whereupon it is Considered by the Court that the Said Defendant have and recover of the Said his Costs by him in this behalf expended and may have &c [p. 473]
