This day Came the parties by their attornies, and after hearing the arguments of Counsel upon the s Motion to dismiss the suit and also the s Motion to Dismiss the appeal taken herein It is Considered by the Court that both of Said Motions be Overruled And issue being joined for trial they put themselves upon the Country Thereupon Came the jurors of a jury to wit Anthony Duffee J M Agnues James Evans Reuben Graves J M Ferris Patrick Doyle James Gray Christopher E Yates David C Ashworth & Willard Gay who being elected tried and sworn well and truly to try the issue joined herein after hearing the evidence and arguments of Counsel retired to Consider of thier verdict [p. 470]
