being duly sworn, on oath deposeth and says, that he attended as witness in the case wherein Joseph Smith is plaintiff, and & <​ are​> defendants for four days at the May Term, A. D. 1844, of the Circuit Court of said at the instance of said plaintiff that he resides in 160 miles from the place of holding this court
Subscribed and sworn to before me this 10 day of May A. D. 1844
