To Joseph Smith Jr. &
To all people to whom these presents shall come Greeting: Know Ye that we and Elizabeth [Conant] Russell wife of the said of County of and State of for the consideration of twelve thousand nine hundred and four dollars received to our full satisfaction of Joseph Smith Jr and , do give grant, bargain sell and confirm unto them the said Joseph Smith Jr and the following described Tract or lot of land situate in the Township of being number nine in the ninth Range of Towships in the in the State of and which is also in the County of and is known by being lot number thirteen and parts of Lots twelve and fourteen and is bounded as follows: Beginning in the centre of the North and South State Road six chains and ninety five links from the Northwest corner of Lot number thirteen measured in said road, at the Southwest corner of Land formerly deeded by Elam Fairchild to Ebenezer Jennings, thence North 89° East forty nine chains to a Stake, thence South 1° East six chains and forty three links to a Stake in the line of Lot number thirteen thence N 89° E along the line of said lot thirteen, seven chains seventy eight links to a Stake at the northeast corner of Lot thirteen thence S. 1° E. Twenty chains five links to the centre of the highway thence S. 89° W. twenty seven chains four links thence continuing with the highway S. 49¼° W. three chains sixty nine links, thence with the Same S 89¾° W. twelve chains to a Stake thence N. ½° W. two chains thirty one links to the line of Lot thirteen thence S. 89° W. three chains Eighty eight links to the S. W. corner of Lot thirteen thence northwesterly along the highway twenty Eight chains twelve links to the place of beginning including all highways laid thereon, and being the same lands deeded to us by the following named persons (viz) By Enoch Morse from the North and near the west corner of Lot fourteen a Strip cut off by the road containing 3.14 Acres, by Joshua Trumbull lot 13 containing 98,21. Acres, & by Elam Fairchild from the South side of lot 12, 30,69. acres. in the whole amounting to One hundred thirty two acres & four hundredths of an [p. 539] acre of Land. be the same more or less but subject to all legal highways——
To have and to hold the above granted and bargained premises with the appurtenances thereof unto them the said Joseph Smith Jr & their heirs and assigns forever to them and their own proper use and behoof. And we the said and Elizabeth Russell do for ourselves and our heirs executors and administrators covenant with the said Joseph Smith and their heirs and assigns that at and until the ensealing of these presents we are well seized of the premises as a good indefeasible estate in fee simple and have good right to bargain and sell the same in manner and form as above written and that the same be free from all encumbrances whatsoever. And furthermore I the said do by these presents bind myself and my heirs forever to Warrant and defend the above granted and bargained premises to them the said Joseph Smith Jr. and their heirs and assigns against all lawful claims and demands whatsoever And I the said Elizabeth Russell do hereby remise, release and forever quit-claim unto the said Joseph Smith Jr. and their heirs and assigns all my right and title of dower in the above described premises, In witness whereof we have hereunto set our hands and seals the tenth day of October in the year of our Lord One thousand Eight hundred and thirty six.

Personally appeared who acknowleded that he did sign and seal the foregoing instrument and that the same is his free act and deed I further certify that I did examine the said Elizabeth Russell separate and apart from her said and did then and there make known to her the contents of the foregoing instrument and upon that examination She declared that she did Voluntarily sign seal and acknowledge the same and that she was still satisfied therewith
