This Indenture, made and entered into this twenty Eighth day of June in the year of our Lord one thousand eight hundred and forty one. Between Joseph Smith, of the County of and State of of the one part and John Wilkie of the and aforesaid of the other part. Witnesseth— that the said Joseph Smith for and in consideration of the sum of two thousand dollars seven hundred dollars to him in hand paid by the said John Wilkie the receipt where is hereby acknowledged, hath granted bargained and Sold and by these presents do grant, bargain, sell, alien and confirm unto the said John Wilkie and to his heirs and assigns, forever, all those lots or parcels of land situate in the County of and state of and described on the plat of the Town of as being Blocks one hundred and twenty eight, one hundred and twenty nine, one hundred and thirty, Lots One, Two and four in Blocks one hundred and thirty one Blocks one hundred and thirty five, one hundred and thirty six, one hundred and thirty seven one hundred and thirty fifty, one hundred and fifty two, and one hundred and fifty three. Lots three in Block one hundreed and thirty four. Lots two and three in Block one hundred and fifty one. Lots three and four in Block one hundred and Eleven. Lots three and four in Block one hundred and twelve— Lots three and four in Block one hundred and thirteen— Lots three and four in [p. 137]Block one hundred and fourteen— Lots three and four in Block one hundred and fifteen. To have and to hold the premises aforesaid, with all the privileges and appurtenances thereunto belonging or in any wise appertaining, unto him the said John Wilkie and his heirs or assigns forever— Provided allways that these presents are upon the this express condition, that if the said Joseph Smith his heirs executors or administrators, shall pay or cause to be paid to the said John Wilkie his heirs, executors administrators or assigns the just and full sum of two thousand seven hundred dollars, together with the interest that my accrue thereon, in manner particularly Specified in a certain note or obligation bearing even date herewith, executed by the said Joseph Smith to the said John Wilkie, then and from thenceforth these presents, and everything herein contained, shall cease and be void, any thing herein contained to the contrary notwithstanding
