To &
you are hereby commanded that setting aside all excuse and delay you be and appear before the undersigned of the 5th judicial circuit on friday next the 6th day of this present month September, atthe house of in at 10 oclock in the forenoon of said day then & there to testify and the truth to Say in a certain enquiry then & there to be had wherein the State of is plaintiff & Joseph Smith Jr. & are defendants on behalf of the herein failnot at your peril given under my hand the 5th [6th] day of September 1838
